The Source - July 2003
It's still a multi-million dollar win for Kim Osorio, but the jilted former editor-in-chief of The Source is only entitled to about half the money she and her lawyers thought she was awarded.
As previously reported by SOHH, The Source's lawyer, Mercedes Colwin, and counsel for the magazine's former co-owners, David Mays and Raymond "Benzino" Scott, called the dollar amount into question in court yesterday (October 31) after a $15.5 million verdict was widely reported in media outlets across the country.
Apparently the plaintiff's attorneys misunderstood the verdict.
After considering an appeal from Osorio's lawyers Kenneth Thompson and Doug Wigdor to recall the jury in order to clarify the verdict, Judge Jed S. Rakoff shut them down and issued his final judgement: Osorio was actually awarded $8 million, not $15.5 million. The amount breaks down to $3.5 million against Benzino for defamation, $4 million for retaliation from Benzino, Mays and The Source together and around $500,000 for lost wages.
Osorio was not awarded any money for her charges of hostile work environment or sexual harassment.
